Penalties for Child Abuse in Texas

In Texas, the penalties for the State of Texas depend on the mental state of the alleged offender as well as the injury inflicted on the child. If convicted of the crime, the alleged offender will face a state jail felony if the act was committed by:

  • Criminal negligence
  • Bodily injury or serious bodily injury by omission
  • Child abuse through reckless actions

A state jail felony is punishable by:

  • Up to 24 months in jail
  • A fine of up to $4,000

If the bodily injury was intentionally or knowingly committed, then the offender will face a third-degree felony. A third-degree felony is punishable by:

  • Up to 10 years in prison
  • A fine of up to $10,000

The alleged offender will be charged with a second-degree felony if they caused serious injury or mental injury to the child by their reckless behavior. A second-degree felony is punishable by:

  • Up to 20 years in prison
  • A fine of up to $10,000
