According to the Texas Penal Code 33.021, an individual can be charged with online solicitation of a minor if he or she electronically messages a minor and does one of the following actions:

  • Solicits a minor to meet another person (which can include the defendant)
  • Communicates with the minor in a sexually explicit manner
  • Exchanges or give sexually explicit material to the minor

The State of Texas classifies the crime as a third-degree felony, which is punishable by up to 10 years in prison and up to $10,000 in fines. The penalty for the crime can be enhanced if the child was 14 years old during the commission of the crime. If this is discovered, then online solicitation of a minor will be enhanced to a second-degree felony, which is punishable by up to 20 years in prison and up to $10,000 in fines.
