Restrictions for Sex Offenders

Restrictions for Sex Offenders

The State of Texas treats sexual assault and related offenses very seriously. Per state law, a person convicted of designated sex crimes must face jail time and fines. Additionally, they must register as a sex offender on the Texas sex offender registry.

Unfortunately, criminal penalties are not all a sex offender must face. There are several restrictions Texas statutes enforce on convicted defendants such as professional restrictions, living restrictions, and employment restrictions. To learn more, contact Austin criminal defense attorney Jackson Gorski at The Law Office of Jackson F. Gorski.

Living Restrictions

An individual who registers as a sex offender becomes limited in where they can live or go on vacation. For example, suppose the individual likes to vacation for a week or more in another country. They would need to register with that country’s sex offender agency to stay in compliance with the law. Suppose they like to attend school outside the country. They still need to register with the local police to be compliant.

If the individual’s sex crime involves a child, the individual may not live within 500 feet of a child safety zone. Child safety zones are schools, childcare facilities, youth centers, juvenile detention centers, parks, playgrounds, and sports fields where children are likely to attend. But this restriction is not all. The individual may face stricter living limitations if the individual’s municipality has other living restrictions.

Travel Restrictions

Sex offense registration comes with certain travel restrictions. For example, the individual must keep their home address updated and notify authorities when buying or selling a vehicle. If the individual travels outside the country, they must alert the local police station, get permission, and register with the local police of whichever state they travel to if they are there for seven or more days.

Work Restrictions

Registering as a sex offender will impact an individual’s professional career. Even after the individual pays their debt to society, employers may refuse to hire them due to their status. The public may access the individual’s registration, including potential employers. Employers may have the right not to hire the individual if the occupation puts patrons or staff at undue risk of harm. In some cases, employers are prohibited from hiring an individual due to their status. For example, employers of sexually oriented businesses cannot hire the individual in any capacity. Working at schools, childcare facilities, and similar fields is also out of the question.
