Sexual Assault of a Child in TX
Sexual assault of a child is defined by Texas Penal Code 22.011 and involves any sexual activity with a person under 17 years of age. According to the statute, a person can be convicted of sexual assault of a child in Texas if he, or she, intentionally or knowingly:
- Causes the penetration of the anus or sexual organ of a child by any means
- Causes the penetration of the mouth of a child by the sexual organ of the actor
- Causes the sexual organ of a child to contact or penetrate the mouth, anus, or sexual organ of another person, including the actor
- Causes the anus of a child to contact the mouth, anus, or sexual organ of another person, including the actor
- Uses the mouth of a child to contact the anus or sexual organ of another person, including the actor.
Sexual assault of a child is prosecuted as an enhanced aggravated sexual assault offense in the State of Texas and is classified as a first-degree felony which could mean a life sentence for the accused if he or she is convicted in the court of law.
