Criminal Penalties

A person convicted of prostitution for the first time will face up to 6 months Travis County jail time and a fine up to $2000.00. Habitual offenders will face enhanced charges, which usually results in a Class A Misdemeanor case. If convicted, a Travis County jail sentence of up to 1 year could be sentenced in addition to a fine that’s not to exceed $4,000.00.

People convicted at least 3 times will have their case classified as a State Jail Felony. State Jail Felony convictions carry a state jail sentence of up to 2 years and a fine of up to $10,000.00.

Third Degree Felony criminal classification will apply to defendants found guilty of soliciting children between the ages of 14 and 18. If a person is convicted of this charge, the offense carries a 2-to-10 year prison sentence with a fine of up to $10,000.00.

If the minor is under the age of 14, the charge is classified as a 2nd Degree Felony which carries a maximum prison sentence of 20 years and that ten thousand dollar fine.

Pimps, traffickers and people who support prostitution as an enterprise can receive anywhere from 1 year up to 20 years for their crime. More serious offenses can receive up to 99 years.

Pimping is classified as a Class B Misdemeanor and can be upgraded to a Class A Misdemeanor if the person was convicted of the offense at least 3 times.
