An Overview of Minor Involved DWI Cases
In short, DUI is the criminal charge applied to minors who are arrested for DWI (Driving While Intoxicated). When an adult is arrested for the offense they’ll be immediately jailed, car towed, and hit a with misdemeanor or a felony criminal charge. For minors, the immediate enforcement of the law isn’t as severe and usually results in a ticket as peace officers aren’t always required to take custody of the offender.
DUI is short for Driving Under the Influence.
DUIA is short for driving under the influence of alcohol.
DUID is short for driving under the influence of drugs.
Texas DUI law is explicit, “Driving or operating watercraft while under the influence of alcohol (or drugs) by a minor” is a crime. First time offenders will be ticketed and charged with a Class C Misdemeanor which will result their liability to paying a fine of up to $500.00. They may also be required to perform community service for up to 40 hours and will likely lose their Texas Driver License.
Habitual offenders that are minors but not children (under 21, but over 17), could face up to 180 days in the Travis County Jail, liable to pay a fine of up to $2,000.00, and required to complete up to 60 hours of community service work and will likely lose their Texas Driver License. Furthermore, some habitual offenders may not qualify for deferred adjudication or deferred disposition, but there are exceptions in some cases.
